Incumbent Vescera Wins
Incumbent Vescera Wins

The confusion over who won the Utica Common Council's 1st Ward seat was caused be an error in the NTS system on the Board of Election's website, according to Democrat Commissioner Kathleen Perez.

An October 30th Appellate Court ruling said Frank Vescera defeated Nedzad Smajic in the democratic primary. Until last week, it seemed that Smajic would have that line. Perez says while officials made sure to remove Smajic's name from ballot's, his name was still in the website's database. So, when officials uploaded the numbers on line-A for the 1st Ward Council seat, they came up on the website under Smajic's name.

Perez says they are working to correct the error on the website to show Vescera won.
