A Utica man is now in custody following a shots fired incident earlier this week.

Officers responded to Chestnut Street and Francis Street at approximately 10:00pm on Monday, November 2, 2015.

According to a written release the Utica Police Department says the following:

"When officers arrived, they saw a man holding another man down to the ground. After separating the men the officers detained them, and learned that there was an argument between two juveniles. As the fight occurred, a large group of 30 people congregated. One of the juvenile's father got involved in the altercation, and he was subsequently attacked by several people. The victim then got involved in the dispute but then attempted to drive away when the suspect started firing a gun at him and the vehicle. When the suspect ran away, the victim followed him in his car and when the suspect fell, the victim exited his car and held him down until the police arrived."

The suspect has been identified as 37-year-old Malik Myers of Watson Place in Utica.

Authorities say a loaded Ruger 9mm handgun with a defaced serial number was recovered at the scene along with several rounds of spent and live ammunition.

Myers now faces the following charges:

  • Criminal Possession of a Weapon (second degree, a felony)
  • Criminal Possession of a Weapon (third degree, a felony)
  • Criminal Possession of a Firearm (a felony)
  • Reckless Endangerment (first degree, a felony)

Myers will answer the charges in court at a later date.
