A member of the Governor Andrew Cuomo's administration has died after being shot on Labor Day weekend.

Carey Gabay was pronounced dead last night, September 16, 2015, after his family had issued a statement that he had been declared brain dead.

The 43-year-old attorney and his brother were walking on a street in the Crown Heights section of Brooklyn when it is believed that he was accidentally caught in the crossfire of a gang shooting.

The two were celebrating J'Ouvert festivities, the official beginning of carnival, all part of the West Indian Day Parade.

Police are still searching for the gunman.

Governor Cuomo released a statement saying, in part, that Gabay was "the epitome of a public servant."  and that "no one should have to experience the pain of losing someone they love to random gun violence."
