Acting State Supreme Court Justice Kimberly O'Connor has ruled that Utica City School District and seven other small city school districts failed to prove the state has not provided students in their districts with a sound basic education.

The court had been weighing a decision in a Maisto versus the State of New York case concerning fair and equitable funding of small city school districts.

Assemblyman Anthony Brindisi says he's "incredibly disappointed" in the decision, which he says is contrary to the facts presented in the case.

Brindisi says he'll continue to fight for a fair and equitable funding formula for Utica and other small city districts.
