The Utica Planning Board has given final site plan approval for a Stewart's Shop on Culver Avenue in East Utica.

The board gave its unanimous approval after an additional traffic study was submitted by Stewart's.

Chuck Marshal, the Real Estate Representative for Stewart's,  says construction on the Culver Ave store will be on hold until a lawsuit filed against the Utica Zoning Board of Appeals seeking to vacate the board's approval of a use variance for Stewart's is settled.

The suit was filed by an area resident and the owner of a nearby Nice 'n Easy store.

Marshal says they'll be submitting building plans for the Culver Avenue location to the city soon.

He says the Stewart's in West Utica will go up this year.
