The conductor of a train says he saw a snowmobile that appeared to have gotten on the tracks and immediately applied the train's emergency brakes and sounded the horn, but it was not soon enough.

55-Year old Bernard C. Joss was riding his 2002 Polaris 700 snowmobile on the tracks just after 11:00pm on Sunday, January 19, 2014 between the Harwood Drive and Miller Road rail crossings in the Oswego County village of Lacona.

In a written release New York State Police say Joss was trying to free his sled when he was hit by the southbound CSX freight train. Joss was pronounced dead at the scene.

In addition to the NYSP, the Oswego County Sheriff's Office, CSX Railroad Police, and the Lacona Fire Department assisted at the scene.

The investigation by New York State Police and CSX Railroad Police is continuing.
