Former State Assembly Speaker Sheldon Silver won't have to report to prison just yet.

A federal judge in Manhattan today delayed Silver's surrender date, while the court considers his appeal.

When Silver was convicted on fraud, extortion and money laundering charges last May, the judge ordered him to begin his 12-year sentence next Wednesday.

Under the judge's new schedule, the earliest Silver needs to report to prison is now October 27th.
