While investigating an accident on State Route 365 state police became concerned about the condition of the driver involved.

The car had rolled over during the accident, which occurred on November 17, 2013, and the driver appeared not to have any serious injuries.

New York State Police in Remsen arrested 28-year old Joseph T. Murphy from Frankfort, New York after he was allegedly discovered to have registered a .23 blood alcohol concentration (BAC) level.

Because this incident would be Murphy's second within ten years he is facing an additional charge.  Both charges are felonies.

He was released and is scheduled to appear in the Town of Trenton court in December.
