A verdict could come as early as June 29 in the case of a Johnson City man accused of setting a revenge arson fire at an apartment house on Floral Avenue in 2015 that killed 4 and 3 year old brothers.

Testimony in the bench trial ended yesterday and Judge Joseph Cawley will decide the fate of 39 year old Dwight Burton.

The defense had argued a couple of the so-called “eye witnesses” were unreliable.

Burton is accused of setting a fire to the building in order to get back at his former girlfriend, Jessica Baxter, who lived in an apartment in the house. Erica Kurtz and her two young boys were staying with Baxter.  Baxter and Kurtz jumped from a third floor window as they failed in attempts to save 3 year old Michael Maxwell and 4 year old Joshua Maxwell.

Both women suffered serious injuries.

Burton faces up to life in prison if he is convicted of murder.

The apartment house has been renovated and turned into a two-story structure but remains vacant.
