BUFFALO, N.Y. (AP) — Authorities say a 21-year-old man has been charged for being involved in a street shootout in Buffalo that left a 12-year-old boy with a severe gunshot wound to his head.

The Erie County District Attorney's Office says Detavion Magee of Buffalo was charged Wednesday with criminal possession of a weapon.

Prosecutors say Magee was walking on an east side street on June 29 when rival gang members pulled up in a vehicle. Officials say a gunfight ensued, with Magee firing back with a handgun.

A stray bullet struck then-11-year-old Juan Rodriguez in the head as he was helping his younger siblings to get inside the family's home to escape the gunfire. The boy is still recovering.

Magee pleaded not guilty and is being held in the county jail without bail.
