The surviving Boston Marathon bombing suspect is charged with conspiring to use a weapon of mass destruction.

19-year old Dzhokhar Tsarnaev is under heavy guard at a hospital after being wounded in his 24-hour flight from justice.

White House spokesman Jay Carney said today Tsarnaev would not be tried as an enemy combatant.

Investigators believe he and his brother planted bombs that tore through crowds at the finish line of the Boston Marathon, killing at least three and injuring more than 170.
