New Trial Sought In Case Of NY Man Accused Of Killing Father

ROCHESTER, N.Y. (AP) — Prosecutors are seeking a new murder trial for a former Ivy League student accused of shooting his father inside the family's suburban Rochester home last year.

The Monroe County District Attorney's Office filed a motion with an appeals court seeking to reverse a judge's decision to dismiss murder charges against 20-year-old Charles Tan.

The former Cornell University student was charged last year after sheriff's deputies called to the family's home in an upscale Pittsford neighborhood found 49-year-old Liang "Jim" Tan dead from shotgun wounds.

The son's trial ended in October in a mistrial after jurors failed to reach a verdict. A judge ruled after the mistrial that prosecutors presented insufficient evidence to support the charges.

The son's defense attorney says the law remains on his client's side.
