New York City Mayor Bloomberg's plan to ban large sugary drinks from restaurants has been ruled unconstitutional by the New York State Court of Appeals.  The four-judge panel  agreed with a lower court's decision from March that ruled that the ban was an overreach of executive power.

The law would have prohibited businesses in the city from selling soda's larger than 16-ounces.  The decision is a blow to Mayor Bloomberg's 'healthy NY' agenda in an effort to combat obesity among city residents.
