ELLICOTTVILLE, N.Y. (AP) — Authorities say a western New York man shot another man after a bar fight in a popular upstate ski town.

State police say 25-year-old Damien Marvin got into an altercation with a 41-year-old man Saturday night in a tavern in the Cattaraugus County village of Ellicottville, 45 miles (72 kilometers) south of Buffalo.

Both men then left the bar and the altercation continued at the village's main intersection, where troopers say Marvin pulled out a legally owned handgun and shot the other man once in the abdomen.

Marvin, of Salamanca, surrendered to police.

The victim was taken to a Buffalo hospital, where he was listed in critical condition.

Marvin was charged with assault. He's being held in the county jail. Jail officials don't know if he has a lawyer.
