Former New York Senate Deputy Majority Leader Thomas Libous will not be sentenced on October 30th, as had been scheduled.

A Federal Judge in White Plains has pushed back the Binghamton Republican’s sentencing date to November 24, 2015 over health concerns.

Libous’ legal team asked for the delay since the 62 year old is due to have another round of chemotherapy starting October 28.

The latest treatment is to follow a CT and bone scan on the 27th.

The long-time Binghamton politician had been diagnosed with prostate cancer in 2009, which later spread to his lungs.

Libous had been convicted in July of lying to the FBI about his connection to his son landing a job with a downstate law firm.

Matthew Libous is currently serving a 6 month sentence in Federal Prison for tax fraud.

The former Senator had asked for a retrial but Judge Vincent Briccetti ruled that Libous had been fairly convicted in July and sentencing would move forward.

Libous could still appeal his conviction after he is sentenced.

Libous faces up to five years in prison under  his conviction.
