In spite of his office issuing several statements in the past saying New York State Senator Thomas Libous’ health is well enough for him to continue doing his work in state government, the New York Post has printed an article containing a plea from the Republican to a judge asking to spare his son jail time to allow Matthew Libous to stay with the Senator in the career politician’s final days.

Tom Libous was diagnosed with prostate cancer in 2009 and, in the statement to the judge who will be sentencing Libous’ son for tax fraud, Libous says he is dying from untreatable cancer.

Matthew Libous’ sentencing was to take place April 29 but has been set back to May 18 in Federal Court in White Plains.

Meanwhile, the senior Libous, who is recovering in Florida from complications from back surgery, is himself, due in court in July to face a felony count of making false statements to the FBI.

The 62 year old has been accused of using his influence as a high-ranking state official to get his son a job with a downstate law firm.

In addition to Libous' plea to the court for leniency, several other letters were presented to the judge, including one from Libous' wife, Fran, saying she needed Mathew's help in caring for her husband as his health deteriorates.
