MAMARONECK, N.Y. (AP) — A Westchester county smoked fish shop once recommended by Oprah on her "Favorite Things" list has been sued by federal prosecutors for repeated findings of listeria bacterium at the business.

The Manhattan U.S. Attorney's office says in a lawsuit filed Tuesday the Smokehouse of New York in Mamaroneck has failed to comply with federal health standards and had multiple positive tests for Listeria monocytogenes. The lawsuit does not claim the shop sold tainted fish or that anyone became sick from its products.

Brett Portier, the shop's operations director, says there has been no listeria found in any finished product during inspections, just on floors. The lawsuit is asking the company to stop selling until the matter is resolved.

Listeria can cause severe flu-like symptoms if a person is infected.
