A State Supreme Court judge has denied Utica Fire Chief Russell Brooks motion to reconsider his lawsuit against the City of Utica.

It's the second time in the past three months the Supreme Court has ruled against Brooks and in favor of the city.

In a statement, Utica Mayor Robert Palmieri says the city is pleased with Thursday's ruling.

Palmieri says while it's never popular to deny anyone's disability claim, the city has an obligation to follow the law and the decision was based solely on the facts and medical evidence after a thorough review of Brook's medical file.

Brooks had filed a lawsuit, claiming the City rejected his application for sick leave benefits related to the leukemia he contracted while working at Ground Zero on 9/11.

A State Supreme Court Judge had ruled earlier that Brooks never formally applied for sick leave benefits and dismissed the lawsuit.
