Following a ruling by the Appellate Division of State Supreme Court, a new Stewart's Shop will be going up on Culver Avenue.

The court dismissed a third and final appeal seeking to overturn a decision by the Utica Zoning Board to allow Stewart's to build at the East Utica location.

Stewart's Project Manager Chuck Marshal says the new store will be 3,675 square feet with three gas pumps. Marshal says they expect to break ground on the Culver Ave location in July.

Meanwhile, he says construction of a new Stewart's on Middle Settlement Road in New Hartford is set to begin before the end of the month

That store scheduled to open sometime between Labor Day and October.

Stewart's also has plans to build a store in Westmoreland.

The company opened its first store in the Utica-area on Court Street in December of 2014.
