A suspect on parole following a murder conviction is now in the hospital after possibly trying to do away with some potential evidence.

Izell Bembry, a 39-year-old who was living on Waverly Place in Utica, will formally face multiple charges when he is released from the hospital.  According to a posting on the Facebook page of the Utica Police Department, "Bembry was hospitalized due to ingesting a large amount of cocaine as our SWAT team was making their entry into the (premises)."

Officers executed a no-knock warrant at Bembry's home on Friday, May 1, 2015.  Inside the home investigators allegedly found cocaine and a .22 caliber rifle.

Bembry faces the following charges:

  • criminal possession of a controlled substance (third degree, a felony)
  • criminal possession of a controlled substance (seventh degree, a misdemeanor)
  • criminal use of drug paraphernalia (two counts, second degree, misdemeanors)
  • criminal possession of a weapon (third degree, a felony)
  • criminal possession of a weapon (seventh degree, a misdemeanor)

Bembry was on parole following a conviction for attempted murder in the second degree. Since January 30, 1997 he has been held at the Cayuga County Correctional Facility and released on parole on July 11, 2012.

He will be held at the Oneida County Jail pending his next court appearance.
