State Police were called to the grounds of the Turning Stone Resort Casino early Thursday morning for reports of a one-car crash in an outdoor parking area.

Troopers Andrew Maurer and Steven Fountain responded to the scene to find a Cadillac CTS had crashed into a tree. It was discovered the tree hit a curb, then crashed into the tree.

During the course of the investigation police interviewed 32-year-old Noble Smith Jr. He claimed that he was distracted by his cell phone and that was the reason he hit the tree. The Troopers claim they smelled alcohol on his breath.

Sobriety tests indicated that Smith Jr. allegedly had a blood alcohol content of .15% State Police also checked on the status of his license and discovered it was suspended. Smith Jr. was ticketed for DWI, Driving with a BAC of .08% or greater, Aggravated Unlicensed Operation in the 3rd Degree, using a cell phone while driving and other traffic charges.  He is scheduled to appear in the Verona Town Court at a later date.
