Environmental investigators are still looking into the impact of a spill of cream and fuel oil into a Delaware County stream.

28 year old Marcus Franklin of Houston, Texas was traveling south on County Route 16 in Delhi at around 7:30 a.m. December 14 when he lost control of his tractor trailer and the cab portion of the vehicle ended up partially suspended over the bridge over Platner Brook.

A passerby showed up with a ladder to help get Franklin out.  He was taken to the hospital for treatment of minor injuries.

He was ticketed for speed not reasonable, moving from a lane unsafely, failure to keep right and a log book violation.

Franklin is also cited by the New York State Environmental Conservation Police in relation to the hazardous material spill into a waterway.

Franklin had been transporting the cream from Michigan to the Saputo Dairy Plant in Fraser.

Authorities say they estimate about 2,500 gallons of cream, which is hazardous to aquatic life, spilled into the brook.
