A State Supreme Court Judge is ruling that two members of the Utica Common Council are not eligible for the Independence party ticket this fall.

The Utica Observer-Dispatch is reporting that Common Council President Frank Meola and Councilman-at-large Jack LoMedico cannot have the Independence endorsement.

A Judge ruled former Utica Mayor Tim Julian has also been removed as the party's executive committee secretary because Julian violated party rules by authorizing the designating forms as both presiding officer and secretary.

The hearing was brought on after Utica Resident John Deater filed an objection with the State Supreme Court.
