The child injured in a buggy and tractor trailer accident this morning in Deerfield is in a Syracuse hospital with a fractured skull.

12 year-old Barrett Sheppard, a passenger in the buggy, was taken to S. Elizabeth's Hospital, but later transferred to SUNY Upstate Medical Center with non-life threatening injuries.

Troopers say the incident happened just before ten this morning when an Amish horse drawn wagon driven by Jonathan Byler, 12, and Isaac Byler, 10, of Poland, attempted to make a left turn onto North Gage Road from the shoulder of the road.

The buggy turned into the path of a tractor trailer driven by John Silvernail, of Fort Plain. When the truck hit the buggy, it was thrown into the air and overturned. A horse was also injured during the accident, but was later euthanized by its owner.

No tickets were issued following the incident because of the Bylers' ages and because buggies are not considered vehicles under New York State's traffic laws.

State Police were assisted at the scene by the Kuyahoora Ambulance, Poland Fire Department and the Oneida County Sheriff's Department.
