An arrest has been made in last night's fatal hit and run accident in Utica.

Utica Police say they were informed by a Good Samaritan of a vehicle that was allegedly being driven erratically.  The witness did not know that the vehicle had just hit a pedestrian but followed the vehicle and called 911 with the location.

The vehicle stopped on Marlboro Road and officers arrived and found a man and woman near the vehicle, described by police as a Nissan pickup truck.  Officers say they became concerned about the individuals' ability to drive, and noticed damage to the truck consistent with those associated with being in an accident.  Officers were unable to determine who had been driving the vehicle.

Investigators later learned that the man had been driving the vehicle.  Officers went to his home where the suspect, identified as 50-year-old Richard Hefferon of Marlboro Road, was arrested.

Hefferon is facing a charge of vehicular manslaughter in the first degree, a felony.  He also faces an additional charge of having a previous DWI conviction in the past ten years.

The name of the pedestrian killed in the accident is still not being released pending notification of next of kin.
