A sign outside a Utica Fire Department firehouse is once again creating controversy

The sign at Fire Station Number 4 on Sheppard Place in South Utica reads "Happy Birthday Jesus, We Love You."

The Freedom From Religion Foundation has asked the Mayor to remove the sign.

Fire Chief Russell Brooks says the sign will not be coming down.

Brooks says he contacted the Thomas Moore Law Center in Michigan, which told him he was completely within his rights to display the sign.

He says the Center will take this case to court pro-bono if someone does bring a lawsuit against the fire department.

Brooks says the sign has been put up by firefighters during the Christmas season for the better part of a decade.
