GLOVERSVILLE, N.Y. (AP) — Police say a break-in at a Mohawk Valley apartment ended with one man charged with burglary, his accomplice shot dead, and the resident charged with possession of a stolen gun.

Gloversville police say 34-year-old Robert W. Phillips Jr. and 22-year-old Gary Terry entered a city apartment Monday night intending to rob resident Jeremy Potter. Potter woke up and pulled out a revolver.

Police say Phillips and Potter struggled and the gun went off. Police arrived shortly after 11 p.m. to find Phillips dead.

Terry turned himself in Tuesday afternoon.

Police say Terry has been charged with burglary and attempted robbery and Potter has been charged with illegal possession of a gun that had been reported stolen.

It could not be determined if Terry and Potter have lawyers to comment.
