US District Court Judge David Hurd has dismissed a lawsuit brought against the City of Utica, Utica Police Chief Mark Williams and other UPD officers.

The suit, filed by Ricky Woods and Sylvester Peterson, alleged First and Fourth Amendment violations for an incident that happened at the Uptown Theater in September of 2011.

Police were called to the Uptown for a report that two African-American men with rifles had entered the theater.

Police say Woods and Peterson were briefly detained by officers because they fit the description of the suspects.

The $4 million dollar lawsuit was dismissed because the plaintiffs failed to show that their First or Fourth Amendment rights were violated.
