An Augusta man is recovering after allegedly hitting a tree.

A local resident heard the crash and found 38-year old John Dincik in his car unconscious. The Good Samaritan called 911.

Dincik was treated for his injuries by emergency personnel in Oriskany Falls.  He was then brought to the hospital where deputies continued their investigation.

Dincik was driving south on North Road in the Town of Augusta when he officials say he missed a turn and hit a tree head-on.  It was determined that alcohol and speed both contributed to the crash.

Dincik is being charged with failure to reduce speed at a curve, failure to keep right, refusing to submit to a breath screening device, and DWI.

Oneida County Sheriff's Deputies were assisted by members of the Oriskany Falls Fire Department, Oriskany Falls Ambulance, and the New York State Police.
