The appeal of the Herkimer County Supreme Court's ruling upholding the Town of Litchfield's ban on industrial wind turbines has been withdrawn.

That means the lawsuit against the town is over and the town's law banning industrial wind turbines stands.

According to the Town's attorney Douglas Zamelis, the industrial wind leaseholders failed to complete their appeal within the time allowed by the appellate rules.

The Town then made a motion to dismiss the appeal and the landowners withdrew their appeal instead of opposing the Town's motion.
