Lee, NY (WIBX) - A man was shot by police Tuesday night after firing a round into the air and then allegedly pointing a rifle at a State Trooper.

It happened on Meadow Brook Drive in the Town of Lee.

State Police say they were called to the home to assist the Oneida County Sheriff's Office with a report of a man acting erratically and armed with a gun.

41-year old James Newbill was shot in both hands and taken into custody.

No officers were injured during the incident.

He was taken to St. Elizabeth Medical Center and then transfered to University Hospital in Syracuse.

Newbill is being guarded with felony charges pending.

The Sheriff''s Office will also have charges pending against Newbill for an incident earlier in the evening when he allegedly rammed a vehicle on Route 26 and forced his way into a home, attacking the person who lived there.

The investigation is continuing.
