(Syracuse, NY)  --  Onondaga County District Attorney, William Fitzpatrick says sex abuse charges can't be filed against former Syracuse University assistant basketball coach Bernie Fine, because the statute of limitations has expired.

However, Fitzpatrick says he found two of Fine's accusers to be credible.  A federal investigation is continuing in regards to a third victim.

Bobby Davis and his step-brother, Mark Lang, accused Fine of molesting them in the 1970s and 80s when they served as ball boys for the Syracuse basketball team.

A third man, Zach Tomaselli, also came forward. He says  Fine sexually abused him in 2002 during a trip to Pittsburgh, when he was 13 years old.

Federal authorities and Pennsylvania officials continue to investigate those allegations.
