NEW YORK (AP) — The New York Police Department has classified the death of a 1-year-old girl as a homicide after the medical examiner found that she suffered from "fatal child abuse syndrome."

Chief Medical Examiner Dr. Barbara Sampson said on Tuesday that Elaina Torabi of Queens, who was found unconscious on the night of Oct. 3, had been injured over a period of time.

The little girl's twin brother was critically injured.

Their mother, Tina Torabi, was arrested on assault charges a day later.

In an October interview with the New York Post, she said her husband had attacked the children before committing suicide.

A call requesting comment was placed to her attorney on Tuesday.

The Queens district attorney's office said Torabi's next scheduled court appearance is on Friday.
