The Utica Police Department has their suspect in custody as a result from the investigation into a shots fired incident on Varick Street.

On August 11th, 2017 UPD was dispatched to the area of Columbia Street and Varick for reports of the shots fired. Upon arrival officers found several handgun casings and they learned that at least two rounds struck a vehicle passing through the intersection of Varick and Columbia. The driver, who was the only person in the vehicle, was not injured.

Police learned the gun shots were the result of a verbal argument that occurred. During the course of the investigation it was learned that the alleged suspect in this case was Dan Crisoptimo-Baez. The investigation revealed the alleged shooter had ties to Puerto Rico and Philadelphia. With the help of law enforcement in Philadelphia and The U.S. Marshals Crisoptimo-Baez was arrested without incident in the Pennsylvania city and is awaiting extradition to Utica.

26-year-old Dan Crisoptimo-Baez is facing several Felony charges including 1st Degree Attempted Assault, 1st Degree Reckless Endangerment, 2nd Degree Criminal Possession and Criminal Possession of a Firearm.
