Southern Tier Republicans are filing a lawsuit challenging New York State Senate candidate Barbara Fiala’s listing on the ballot as a candidate on the Woman’s Equality Party line.

The Broome Republican Committee says Governor Andrew Cuomo illegally created the party and the line on the ballot and put Fiala on the line after initially naming her the chair of the new party.

In a statement from Republican Committee Chair, Bijoy Datta says two different State Supreme Court Justices ruled Cuomo and Fiala broke the law in their attempt to create the party then tried what he called a fraudulent scheme to allow Fiala to run on the party’s line.

Fiala is the Democratic Party candidate to replace Republican former state Senator Thomas Libous in the 52nd district. Former Broome County Undersheriff Fred Akshar is the Republican’s pick for the seat.

The election is November 3.
