A State Supreme Court Judge has dismissed a challenge to a plan to build a Stewart's Shop in East Utica.

A petition filed in January sought to overturn the city Zoning Board of Appeal's decision in December granting Stewart's a revised use variance for the Culver Avenue property.

Stewart's Project Manager Chuck Marshal says that gives Stewart's the green light to build a store on Culver Ave.

Marshal tells WIBX they're optimistic that they'll be putting shovels in the ground by summer.

Stewart's Shops also has plans to build a new store off of Middle Settlement Road in New Hartford.

Marshal says if everything goes according to plan, they hope to begin construction in August and open by the fall.

Stewart's opened a store on Court Street in West Utica in November.
