Parole Denial Upheld For Driver In Deadly 1981 Brinks Heist

ALBANY, N.Y. (AP) — A New York appellate court has overruled a judge who ordered a new parole hearing for the getaway car driver in a bungled 1981 Brinks heist that left three people dead.

In a decision released Tuesday, the state Appellate Division overruled a state Supreme Court judge's April ruling that annulled the state parole board's denial of 69-year-old Judith Clark's early release. But the panel ordered a new administrative appeal of Clark's parole denial, agreeing with her attorneys that she had been wrongly denied documents.

Clark has been in prison for 37 years for the suburban New York robbery that led to the deaths of two police officers and a security guard.

Gov. Andrew Cuomo praised Clark's behavior as a prisoner when he commuted her sentence in 2016 to make her eligible for parole.
