The group No Hospital Downtown is filing a lawsuit against Mohawk Valley Health System's downtown Utica hospital project.

Co-Founder Jim Brock says the suit was filed on Thursday in Albany by the Albany-based West Law Firm.

The lawsuit challenges the findings of the project’s State Environmental Quality Review.

The suit is being filed against the City of Utica Planning Board, New York State Office of Parks, Recreation and Historic Preservation, Dormitory Authority of the State of New York and MVHS.

The Planning Board accepted the SEQR findings last month.

Brock did not rule out a possible eminent domain lawsuit in the future.

MVHS Executive Vice President/COO Robert Scholefield issued the following statement regarding the lawsuit:

“At this point, our legal team has not received any filings. We will continue to move forward as scheduled with the new regional medical center in Downtown Utica.”
