A State Supreme Court Judge has ruled that the counting of ballots in the 22nd Congressional District race between Democrat Anthony Brindisi and Republican Congresswoman Claudia Tenney can proceed.

As a result of Tuesday's decision, all eight counties will move forward with conducting a re-canvass and a count of absentee and provisional ballots this week.

The re-canvassing and counting of absentee ballots will begin this morning in most counties.

Brindisi leads Tenney by more than 1,200 hundred votes.

Tenney's campaign issued the following statement on the court decision:

“We are pleased the Judge addressed security of ballots but allowed local electoral boards to proceed with counting of tens of thousands of absentee ballots, military ballots and provisional ballots under a uniform process which best assures the integrity and counting of ballots,” said Tenney campaign manager Raychel Renna.
