Ava, NY (WIBX) - An Ava man was charged with attempted murder and assault following a Sunday morning shooting in the Town of Ava.

State Police say 35-year old Albert Nellenbach shot 31-year old Jesse Wilcox of Boonville.

Police say Wilcox had gone to Nellenbach's home along with his wife and step-father to look for his brother.

Investigators say they looked around the outside of the house then left without going to the door.

They later returned to the house and observed Nellenbach in a sleeping bag in the tree line on the property.

As they walked toward him, deputies say Albert suddenly jumped up and started shooting.

Wilcox, who was shot in the earlobe, elbow and back with a 22-caliber rifle, is in stable condition at Upstate University Hospital in Syracuse.

The investigation is continuing.
