An Oneida County man is in hot water following a Leandra's Law DWI arrest.

According to New York State Police, a vehicle was observed on Turin Road going 63 in a 40 mile-per-hour zone. Oneida County 911 began a "Be On The Lookout" order for the same vehicle as being an erratic driver.

A Trooper later observed the vehicle in a snowbank and discovered the driver in an unconscious state with the accelerator fully depressed.

The driver, later identified as 37-year-old Jarid Taciak, became conscious and attempted to free the vehicle from the snowbank as he ignored commands from State Police. Troopers also noticed a 4-year-old in the back seat not properly secured.

After Troopers were able to breach the driver's side window, they were able to unlock the doors. Taciak began punching and kicking a Trooper. As a result, another Trooper applied a one-second burst of pepper spray to subdue the driver and removed the child from the vehicle.

With the assistance of Rome Police, authorities were able to finally get Taciak into custody without further incident. Jarid B. Taciak of Lee Center is charged with Aggravated DWI, Endangering the Welfare of a Child, Criminal Possession of a Controlled Substance, Resisting Arrest and Obstructing Governmental Administration. He was also issued several traffic tickets including Child Not Properly Restrained and Speeding.

Taciak was transported to Oneida County Jail for arraignment.
