Utica, NY (WIBX) - Utica police responded to the parking lot of the Walmart Superstore, located on Horatio Street, in regard to a 911 call for a domestic dispute.

When police arrived they spoke to an off-duty New York State Trooper, who told officers that she was walking to her vehicle when she witnessed a heated argument between a male and a female.

When the off-duty trooper intervened, the female remained on scene and the male left the parking lot, leaving behind a hypodermic needle; that needle contained heroin, according to police.

The female told police that she went to Walmart to go grocery shopping and when she was leaving the store, she found her husband sitting in his vehicle with another woman - an argument ensued.

Utica Police caught up with the male, 29 year old  Duane Nichols, on River Road.  The Frankfort man was arrested and charged with criminal possession of a controlled substance in the 7th degree.
